Terms of service & end-user licence agreement

These terms apply to software and services provided by Cairnware, the trading name of an individual developer based in Singapore ("we"), including our Apify Actors and Atlassian Marketplace apps (the "Products"). By installing or using a Product, you agree to these terms. Where a marketplace's own terms apply (for example the Atlassian Marketplace Terms of Use or the Apify Terms and Conditions), those terms govern purchasing and billing.
1. Licence
We grant you a non-exclusive, non-transferable licence to use the Products for your internal business purposes during your paid or free subscription term, and for the number of users you have licensed. You may not resell, sublicense, reverse engineer (except as the law allows) or use the Products to build a competing product.
2. Your responsibilities
You are responsible for your inputs, for how you use the outputs, and for complying with applicable laws and the terms of any third-party websites or services involved, including data protection laws. Don't use the Products for unlawful purposes or to infringe anyone's rights.
3. Fees
Fees are shown on the relevant marketplace listing and are billed by that marketplace. Pay-per-event Actors charge only for the events described in their pricing section.
4. Support and updates
We provide support by email as described on our support page. We may update the Products to fix issues, add features or respond to changes in third-party services. We'll give reasonable notice before removing major functionality.
5. Data
Our privacy policy describes how we handle data. You keep all rights to your content.
6. Warranty disclaimer
The Products are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Third-party data sources can change or become unavailable at any time.
7. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to the Products is limited to the amount you paid us for the Product in the 12 months before the claim.
8. Termination
You may stop using a Product at any time. We may suspend or end access if you breach these terms. Sections 6–9 survive termination.
9. Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction, unless mandatory consumer law where you live says otherwise.
